Battles over energy pipelines pit private landowners, local community representatives, and environmentalists against energy corporations and industry supporters, sometimes drawing opposition and attention from well beyond the impacted regions, as in the case of the Standing Rock\/Dakota Access Pipeline.  Stakeholders must navigate complex government regulatory processes, interpret technical and scientific reports, and endure lengthy and expensive court battles. As with other forms of environmental injustice, the contentious construction of pipelines often disproportionately impacts communities of lower economic development, people of color, and indigenous peoples; pipelines also pose potential short and long-term health and safety threats. With the expansion of energy pipelines carrying fracked oil and gas across the United States and abroad, the moment is ripe for teaching about pipeline projects and engaging students and community members in learning about methods for mobilization. Two rulings are at the heart of the book: Wrotham Park Estate v Parkside Homes and Attorney-General v Blake. These two cases can be said to have established gain-based remedies in English contract law. However, the principles that underpin these remedies are not entirely clear and are subject to debate. This book analyses these principles through the lens of compensatory and restitutionary approaches. Moreover, it applies a comparative analysis of these approaches through the lens of the civil law jurisdiction in Poland. Since the term ‘compensation’ is not a universal concept, the book distinguishes between two rationales in the compensatory analysis. The first, reparative compensation, is defined as a form of monetary recompense for loss or damage actually suffered. The second, substitutive compensation, represents a monetary equivalent to a right that a person has been deprived of or denied. Both rationales require the application of a broad notion of loss in order to make gain-based remedies workable in both English and Polish law. In contrast, ‘restitution’ states that a person cannot be permitted to profit from their own wrongdoing. Based on this principle, the book argues that gain-based remedies could be applied under Polish law through the rules of unjust enrichment. However, in order to do so, a broader understanding of the subtraction prerequisite (the enrichment being at the aggrieved party’s expense) would have to be adopted. The book concludes that unjust enrichment is a more natural way of implementing gain-based remedies in civil law jurisdictions.\u003c\/p\u003e","brand":"Gardners","offers":[{"title":"Default Title","offer_id":52911146008855,"sku":null,"price":13700.64,"currency_code":"INR","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0679\/6918\/8119\/files\/9783031254529.jpg?v=1781261506"},{"product_id":"mathematical-modeling-of-inland-vessel-maneuverability-considering-rudder-hydrodynamics-9783030474751","title":"Mathematical Modeling of Inland Vessel Maneuverability Considering Rudder Hydrodynamics","description":"\u003cp\u003eThis book demonstrates that different rudder configurations have different hydrodynamic characteristics, which are influenced by the profile, the parameters, and the specific configuration. Such instruments are necessary in order to allow supreme courts to fulfil their main duties, that is, the administration of justice in individual cases (private function) and providing for the uniformity and development of the law within their respective jurisdictions (public function). If the number of cases at the supreme court level is too high, the result is undue delays, which are mainly problematic with regard to the private function. It may also put the quality of the court’s judgments under pressure, which can affect its public and private function alike. Thus, measures aimed at avoiding excessive caseloads need to take both functions into account. Increasing the capacity of the court to handle larger numbers of cases may result in the court being unable to adequately fulfil its public function, since large numbers of court decisions make it difficult to guarantee the uniformity of the law and its development. Therefore, a balanced approach is needed to safeguard capacity and quality. As shown by the contributions gathered here, the nature of reform in this area is not the same everywhere. There are a variety of reasons for this heterogeneity, ranging from different understandings of the caseload problem itself, local conceptions regarding the purpose of the Supreme Court, and strong entitlements concerning the right to appeal to budgetary restrictions and extremely rigid legislation. The book also shows that the implementation of similar solutions to case overload, such as access filters, may have different effects in different jurisdictions. The conclusion might well be that the problem of overburdened courts is multifactorial and context-dependent, and that easy, one-size-fits-all solutions are hard to find and perhaps even harder to implement.\u003c\/p\u003e","brand":"Gardners","offers":[{"title":"Default Title","offer_id":52911443116311,"sku":null,"price":18705.44,"currency_code":"INR","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0679\/6918\/8119\/files\/9783030637316.jpg?v=1781270126"},{"product_id":"research-methods-in-modern-urban-transportation-systems-and-networks-9783030717087","title":"Research Methods in Modern Urban Transportation Systems and Networks","description":"\u003cp\u003eThis book presents many valuable research methods useful in conducting research in modern urban transportation systems and networks. There is a growing need for affordable solutions that make use of cutting-edge technology like artificial intelligence (AI), machine learning (ML), and the Internet of Things (IoT). The efficiency, sustainability, and safety of transport networks can be greatly increased by implementing an Internet of Things (IoT) and machine learning (ML)-based smart road transport system. Install sensors on roadways and intersections to gather data on traffic conditions in real time, such as vehicle density, speed, and flow. Predicting traffic patterns is done by analyzing the gathered data using machine learning algorithms. This can lessen traffic, enhance overall traffic management, and optimize traffic signal timings. Vehicles equipped with Internet of Things devices can have their health monitored in real time. Parameters including lane changes, brake condition, tire pressure, and engine performance can all be monitored by sensors. Based on the gathered data, ML models are used to forecast probable maintenance problems. By scheduling preventive maintenance, failures can be avoided and overall road safety can be increased. Create a smartphone app that would enable drivers to locate parking spots in their area. To forecast parking availability based on past data, the time of day, and special events, apply machine learning algorithms. Integrate Internet of Things (IoT) sensors into fleet vehicles to monitor their performance, location, and fuel consumption. To maximize fleet efficiency, reduce fuel consumption, and plan routes more effectively, apply machine learning algorithms. Train ML models to forecast the quickest and most efficient routes with the help of historical data analysis. Route recommendations for drivers or fleet management systems can be constantly adjusted with real-time updates, which contain real-time data on road conditions, accidents, and construction.
