It considers the state perspective on border regulation, subjecting day-to-day practices of EU visa policy implementation to close analytical scrutiny. The objects of the analysis are three European Member States-France, Belgium, and Italy-that implement EU visa policy in Morocco, a country whose nationals are considered to be a migratory 'risk' for the EU. The book focuses on the implementation of EU visa policy in the consulates of Belgium, France and Italy in Casablanca. The empirical research and the comparative perspective make this book distinct. The book uses a 'comprehensive implementation approach' by taking account of the local, national and supranational locations of policy-making. It builds on in-depth pioneering fieldwork and a comparative research design that includes those three locations. The research design has determined the evolving of the puzzle and the realizing of the unanticipated: cross-national differences diminish when policy is put into practice. Extensive research into the visa sections of those EU Member States provides highly original material that sheds light on the obscure black box of EU visa policy implementation, therefore contributing to policy studies, migration studies, and studies on the European Union.

This book offers an empirical and theoretical account of the mode of governance that characterizes the Bologna Process. In addition, it shows how the reform materializes and is translated in everyday working life among professors and managers in higher education. It examines the so-called Open Method of Coordination as a powerful actor that uses "e;soft governance"e; to advance transnational standards in higher education. The book shows how these standards no longer serve as tools for what were once human organizational, national or international, regulators. Instead, the standards have become regulators themselves - the faceless masters of higher education. By exploring this, the book reveals the close connections between the Bologna Process and the EU regarding regulative and monitoring techniques such as standardizations and comparisons, which are carried out through the Open Method of Coordination. It suggests that the Bologna Process works as a subtle means to circumvent the EU's subsidiarity principle, making it possible to accomplish a European governance of higher education despite the fact that education falls outside EU's legislative reach. The book's research interest in translation processes, agency and power relations among policy actors positions it in studies on policy transfer, policy borrowing and globalization. The topics covered include the history of the union, its nature as an empire in the making compared to historical successors as well as current USA and China, formation of union level statistical data and policy documents, paradoxes of fiscal governance, social innovation policy, youth and education policy, energy policy and foreign policy with particular regard to Russia. The last couple hundred years in Romania's history have been marked by change of political regimes, but this manuscript pays equal attention to an important continuity in Romania's ontological world: its understanding of the landscape, and the relationship between Romanian people and their land. From political discourses to children's books, to literature, and explanations found for everyday events, the book follows the ways in which the landscape of Romania has been understood as a sentient being imbued with willpower and ability to act on the world. The sentience specific to Romania's landscape is characterized by xenophobia-a fear and distrust of ethno-religious others-that has been historically interpreted by Romanians as manifesting through acts of violence enacted by the landscape towards various groups of humans understood as dangerous to the country's unity. The novelty of this book lies in the fact that it is an in-depth analysis of an ontological world in which sentient landscapes are de-romanticized and presented in their uncomfortable complexity. The concept of sentient xenophobic mountains can add a great deal to the current literature on the ontological turn and ontological multiplicities, by questioning binaries like colonized/colonizer, indigenous/colonial, sentient landscape/industrial superpower. Romania's history makes it a good case study for this exercise, as the country has been at the margins of empires, both desired because of its natural resources and rejected because of the perceived inferiority of its people, both racialized and racist, both neoliberal and imagining absolute sovereignty.

This book examines corruption in public procurement in three Member States of the EU, reviewing their different approaches to combating corruption, and the extent to which the transparency principle is applied in their procurement systems. Forty-one individual case studies of same-sex attracted men and women, in their own words, made an eye-catching component of Krafft-Ebing's most important work, PsychopathiaSexualis. Although the psychiatrist probably edited the autobiographical case studies, with the racier passages rendered in rather rudimentary Latin, what is particularly remarkable is that he preserved an unmistakeable queer discourse in some of the case studies that disputed the pathologising ideologies of the psychiatric texts in which they were embedded. Most of the autobiographies of same-sex attracted men follow the discursive patterns established in nineteenth-century psychiatry in providing descriptions of body features including genital size and shape, mental and physical health, family histories of health and disease, and accounts of life events from childhood to the present. This was because these men had been following Krafft-Ebing's works and were now using their autobiographical contributions in Psychopathia Sexualis as a platform for negotiating the parameters of sexual orientation. Women's sexuality was a relatively undeveloped component of Krafft-Ebing's sexology but there are four case studies of women containing autobiographical content. Similarly, gender variance was hardly differentiated from sexuality at this period, but there are three autobiographies that clearly articulate cross gender identification, anticipating the future categories of transsexual and transgender. Krafft-Ebing reserved his therapeutic interventions to those individuals attracted to both sexes where hypnosis could supress same sex urges. Seven of these individuals supplied sexual autobiographies with two of them undergoing treatment as part of the overall case study. Together, these forty-one accounts give the reader a window into queer self-conceptions in Austria and Germany as the nineteenth century drew to a close.

This book investigates how the EU member states' domestic energy policies have transformed in the last two decades as a consequence of horizontal and vertical integration forces. Suicidal people committed capital crimes with the explicit goal of “earning” their executions, as a short-cut to their salvation. Desiring to die repentantly at the hands of divinely-instituted government, perpetrators hoped to escape eternal damnation that befell direct suicides. Kathy Stuart shows how this crime emerged as an unintended consequence of aggressive social disciplining campaigns by confessional states. Paradoxically, suicide by proxy exposed the limits of early modern state power, as governments struggled unsuccessfully to suppress the tactic. Some perpetrators committed arson or blasphemy, or confessed to long-past crimes, usually infanticide, or bestiality. Most frequently, however, they murdered young children, believing that their innocent victims would also enter paradise. The crime had cross-confessional appeal, as illustrated in case studies of Lutheran Hamburg and Catholic Vienna. Winner of The 2024 Natalie Zemon Davis Prize. “What to do about women (and sometimes, men) who gruesomely murdered children because of their own “weariness with life?” This was a dilemma faced by elites in German-speaking lands during the seventeenth and eighteenth centuries, and engaged by Kathy Stuart in this strikingly original monograph. A pervasive, if not largely forgotten behavioral pattern featured women who wished to end their lives but feared the doctrine held by Catholics and Protestants alike, that their souls would then face certain damnation. Instead, they would murder a child: their own, someone else’s, even one chosen at random, and immediately turn themselves into the authorities. This form of “suicide by proxy,” as Stuart terms it, resulted in their execution to be sure, but gave them a chance to repent beforehand. To elucidate this troubling history, she mines an impressive array of primary sources from archives throughout Germany and Austria, as well as broadsheets and other forms of art. She draws penetrating insights from law, gender studies, religion, and medicine. To her sophisticated use of empirical research and interdisciplinary perspectives Stuart adds a sense of compassion for these desperate women and the parents of the children murdered during this time of religious and social upheaval.”

This book examines the role that science and culture held as instruments of nationalization policies during the first phase of the Franco regime in Spain. Slavery is legally defined, using the established international law definition, and both the status of slavery in Europe before the Early Modern Period and the Atlantic slave trade are discussed. Secondly, the book assesses the legal origins of the free soil principle in England, France and the Low Countries during the period 1500–1650 and discusses the legal repercussions of slaves coming to England, France and the Low Countries from other countries, where the institution was legally recognized. Thirdly, it addresses the further development of the free soil principle during the period 1650–1800. The book also demonstrates how rights discourse infiltrated the discussion regarding problems that were previously addressed in arguments concerning morals, social justice and equity. Although Finland never had overseas colonies, the authors argue that the country was undeniably involved in the colonial world, with Finns adopting ideologies and identities that cannot easily be disentangled from colonialism. This book explores the concepts of ‘colonial complicity’ and ‘colonialism without colonies’ in relation to Finland, a nation that was oppressed, but also itself complicit in colonialism. It offers insights into European colonialism on the margins of the continent and within a nation that has traditionally declared its innocence and exceptionalism. The book shows that Finns were active participants in various colonial contexts, including Southern Africa and Sápmi in the North. The book covers a broad period from the ‘first colonial empires’ that existed prior to 1830, the ‘new imperialism’ of the late nineteenth and early twentieth centuries, the process of decolonisation in the mid-twentieth century, and the ‘afterlives’ of colonial regimes in France and newly-independent states. Building on recent scholarship, this volume examines the extension of imperialism into the post-colonial period. The chapters examine a range of topics developing our understanding of the reasons why colonial states saw the family as a site for biopolitical intervention. The authors argue that experts built a racialised body of knowledge about colonial populations through census data and medical understandings of problems such as child mortality and infertility. They show that by analysing and compiling dataon fertility, population growth (or decline), and health, this fuelled interventions designed to ensure a stable workforce, and that protecting children and mothers, vaccinating vulnerable populations, and creating modern, sanitary housing were all initiatives also aimed at serving larger goals of preserving colonial rule. Finally, the book shows that social welfare projects during the French Empire reflected concerns about race, differential fertility, and migration that continued well after decolonisation.

This book explores the evolution of the role of the heirs to the throne of Italy between 1860 and 1900. It sheds light on the soft power the Italian royals were attempting to generate, by identifying and examining four specific areas of monarchical activity: firstly, the heirs’ public role and the manner in which they attempted to craft an Italian identity through a process of self-presentation; secondly, the national, royal, linguistic and military education of the heirs; thirdly, the promotion of a family-centred dynasty deploying both male and female elements in the public realm; and finally the readiness to embrace different modes of mobility in the construction of italianità. After decades of having been neglected by legal scholars, international and European monetary law has attracted increasing attention in recent years. With the European Economic and Monetary Union (EMU), a full-fledged monetary union between sovereign States has been established for the first time in history. Its construction is primarily a work of law, with the Treaties on European Union (TEU) and on the Functioning of the European Union (TFEU) together with a number of protocols forming the constitutional basis. Yet, European monetary Integration has never taken place in isolation from international developments. Moreover, international monetary law, namely the Articles of Agreement of the International Monetary Fund (IMF) has always played a role - initially as the external monetary addition to the internal market project, after the breakdown of the Bretton Woods System in the 1970s as one of the major driving forces for monetary Integration within the EU. By examining the political dimension of imperial expansion and the power of words in shaping public opinion, it sheds light on the ways in which liberal ideas developed in the nineteenth century. In contrast to Britain, French imperialism in the third quarter of the nineteenth century was fostered by a Bonapartist regime that liberals needed to fight in order to build their own political brand. The author argues that the 1860s were not so much a period of ‘liberal empire’ in France as has traditionally been suggested, since liberals were in fact more conveyers of political change rather than supporters of the regime. To demonstrate how French liberals succeeded in configuring an alternative political option, the book explores their attitudes to the expanding colonial empire of Napoleon III in the 1850s and 60s through the analysis of parliamentary debates, the press and published texts.Providing three in-depth case studies on Bonapartist expansion projects in Algeria, Cochinchina and Mexico, the book provides new insights on the foundations of the liberal position on imperialism, and the intellectual outlooks and belief systems that informed these views. Since the beginning of the European integration process, they have been used to combat trade practices which are considered "unfair" and their distortive effects on competition in the internal market. However, while the imposition of trade defence measures aims to level the playing field between EU producers and their foreign competitors, it also produces negative effects on competition itself. Based on the role attributed to competition and trade defence policy respectively throughout the European integration process, this book argues that the trading bloc''s trade defence instruments should not be designed or applied with the objective of granting maximum protection to EU producers, but that their use should be limited to what is necessary to ensure fairness in competition between EU producers and exporting producers. However, an analysis of the changesmade to the European Union''s Basic Anti-Dumping Regulation and the Basic Anti-Subsidy Regulation by the Trade Defence Modernisation Package reveals that several aspects of the European Union''s modernised trade defence instruments do not meet this requirement. Rather than being limited to offsetting the unfair competitive advantages of producers practicing dumping or benefiting from subsidies, the reformed provisions go beyond this, distorting competition in favour of the EU industry instead. Furthermore, the book critically assesses the reformed rules relating to the integration of social and environmental aspects in the imposition of anti-dumping or anti-subsidy measures as well as the modernised basic regulations’ compatibility with WTO law.

Providing a historical overview of healthcare in Italy from its unification in 1861 to the present COVID-19 pandemic, this book analyses the political, social and cultural impact of Italian healthcare policy and medicine. The term indigénat is synonymous throughout the francophone world with the rigours and injustices of the colonial era under French rule. The indigénat regime or ''Native Code'' governed the lives of peoples classified as French ''native'' subjects in colonies as diverse as Algeria, West Africa, Madagascar, Indochina and New Caledonia. In New Caledonia it was introduced by decree in 1887 and remained in force until Kanak — New Caledonia’s indigenous people — obtained citizenship in 1946. Among the colonial tools and legal mechanisms associated with France’s colonial empire it is the one that has had the greatest impact on the memory of the colonized. Focussing on New Caledonia, the last remaining part of overseas France to have experienced the full force of the indigénat, this book illustrates the way that certain measures were translated into colonial practices, and sheds light on the tensions involved in the making of France as both a nation and a colonial empire. This book explores how children’s literature and literacy could at once regulate and empower young people in the eighteenth-century Dutch Republic. Rather than presenting the history of childhood as a linear story of increasing agency, it suggests that we view it as a continuous struggle with the impossibility of full agency for young people. This volume demonstrates how this struggle informed the production of books in a historical context in which the development of independent youths was high on the political agenda. In the past decade, the rule of law in Europe has been put under strain by both external and internal factors. The term “illiberal democracies” is sometimes used to describe the rise of a phenomenon in which the fundamental values of the European legal order, as enshrined in the European Convention of Human Rights and in the Charter of Fundamental Rights of the European Union, are called into question. The preservation of the independence of the judiciary, of the freedom of expression and the protection of journalists are among the values under threat. But these challenges are also present within the older democracies in which emergency regimes have become more common. As the European Union’s sanctions regime shows, striking a balance between security and the rule of law, of which fundamental rights are an intrinsic part, is a constant challenge. Focusing onthe European courts’ responses to these threats, the book discusses how courts could provide the ultimate line of defense. In fact, sector-specific legislation, including Food Law, largely ignores online transactions. In this context, the book evaluates the impact that online marketplaces are having on European Union sector-specific legislation and its e-nforcement. The goal is to assess whetherthe existing regulatory and policy framework are sufficient for promoting compliance and bridging the enforcement gap in the digital single market. Focusing on the e-food market, the book presents a state-of-the-art overview of how online marketplaces are altering EU law and its enforcement by public authorities.

international-legal-responsibility-of-the-european-union-in-the-context-of-the-world-trade-organization-in-areas-of-non-conferred-competences-9783319571775
International Legal Responsibility of the European Union in the Context of the World Trade Organization in Areas of Non-Conferred Competences

This work focuses on the EU’s participation in the Dispute Settlement Proceedings (DSP) of the WTO for matters of non-conferred competences. Such fallacies are rooted in the blurred nature of the distribution of powers in the EU polity. In order to tackle the issue of international responsibility, the analysis is based on the facts of a real-world case. Based on the tenets of public international law, the law of mixed agreements and the EU constitutional principles, the book puts forward a model for the EU’s participation in the DSP, and for the reallocation of burdens to the respective responsible entity. A mortgage allowed a loan to be secured with land or other property, and the practice has been linked to the transformation of the agrarian economy that paved the way for modern economic growth. Historians have viewed the mortgage both positively and negatively: on the one hand, it provided borrowers with opportunities for investment in agriculture; but equally, it exposed them to the risk of losing their mortgaged property. The case studies presented in this volume reveal the variety of forms that the mortgage took, and show how an intricate balance was struck between the interests of the borrower looking for funds, and those of the lender looking for security. It is argued that the character of mortgage law, and the nature of rights in land in operation in any given the place and period, determined the degree to which mortgages were employed.Over time, developments in these factors allowed increasing numbers of peasants to use mortgages more freely, and with a decreasing risk of expropriation. Its contents cover the issues that are likely to be most controversial in any public health crisis. It starts by discussing non-pharmacological measures, such as the appropriateness of confinement, how to control compliance with public health measures and the ethical, legal and social acceptability of health certificates. Then it turns to issues related to the production, distribution and administration of vaccines, with a particular focus on the design and implementation of vaccination policies. Finally, it analyses the most appropriate criteria to develop a triage, when the situation brings us to this terrible scenario. The analyses presented in this book are based on the ethical and legal frameworks, as well as the social context, of the European Union, and aims to address the main dilemmas faced byany liberal democracy dealing with a pandemic: how to reconcile the defense against a public health crisis together with a respect for fundamental rights and freedoms. The European legal systems have developed a number of conceptual tools designed to ensure that there is no room for arbitrariness in the restrictions introduced by the political power in emergency situations, and this book builds upon these tools. The Ethical, Legal and Social Issues of Pandemics: An Analysis from the EU Perspective is a predominantly practice-oriented book, which will help policy makers to adopt policies that effectively combine public health needs with individual rights and freedoms. It will also help health care givers to understand better the ethical and legal issues involved in their work and citizens, in general, to participate in public decision making in an informed manner. Using the Ligue des Droits de L’Homme (LDH) - or the League of the Rights of Man - as a narrative thread for this chronological study, the book tracks the gradual expansion of human rights in France in the wake of the two world wars, the Algerian quagmire and decolonisation more generally. Examining the capital role of the LDH whilst also highlighting the role of individuals and key activists, the book helps us to contextualise the quandaries faced by unseen minorities, particularly colonial subjects and women. The analysis also demonstrates the influence of French human rights activism on key international documents of human rights law, such as the Universal Declaration of Human Rights. The LDH occupies a central place in French justice debates and is therefore an ideal template to analyse the rising influence of humanitarianism and crimes against humanity in French causes célèbres from the 1970s onwards. However, the author goes further to look beyond the LDH and even France itself, offering wide-ranging surveys of dominant rights issues across Europe at any given period. The standard narrative of nineteenth-century imperialism in Latin America is one of US expansion and British informal influence. However, it was France, not Britain, which made the most concerted effort to counter US power through Louis-Napoléon’s military intervention in Mexico, begun in 1862, which created an empire on the North American continent under the Habsburg Archduke Ferdinand Maximilian. Despite its significance to French and Latin American history, this French imperial project is invariably described as an “illusion”, an “adventure” or a “mirage”. This book challenges these conclusions and places the French intervention in Mexico within the context of informal empire. It analyses French and Mexican ideas about monarchy in Latin America; responses to US expansion and the development of anti-Americanism and pan-Latinism; the consolidation of Mexican conservatism; and, finally, the collaboration of some Mexican elites with French imperialism. An important dimension of the relationship between Mexico and France, explored in the book, is the transatlantic and transnational context in which it developed, where competing conceptions of Mexico and France as nations, the role of Europe and the United States in the Americas and the idea of Latin America itself were challenged and debated.

This book examines the politics of legitimacy as they played out across Europe in response to Napoleon’s dramatic return to power in France after his exile to Elba in 1814. Moreover, as the rest of Europe united against him, he had to marshal popular support for his new regime, while simultaneously demanding men and money to back what became an increasingly inevitable military campaign. The initial return – known as ‘the flight of the eagle’ – gradually turned into a dogged attempt to bolster support using a range of mechanisms, including constitutional amendments, elections, and public ceremonies. At the same time, his opponents had to marshal their resources to challenge his return, relying on populations already war-weary and resentful of the costs they had had to bear. Food safety is a critical goal in the protection of individuals’ right to health and the flourishing of the food and feed market. Big Data is fostering new applications capable of enhancing the accuracy of food safety risk assessments. An extraordinary amount of information is analysed to detect the existence or predict the likelihood of future risks, also by means of machine learning algorithms. Big Data and novel analysis techniques are topics of growing interest for food safety agencies, including the European Food Safety Authority (EFSA). This wealth of information brings with it both opportunities and risks concerning the extraction of meaningful inferences from data. However, conflicting interests and tensions among the parties involved are hindering efforts to find shared methods for steering the processing of Big Data in a sound, transparent and trustworthy way. While consumers call for more transparency, food business operators tend to be reluctant to share informational assets. This has resulted in a considerable lack of trust in the EU food safety system. A recent legislative reform, supported by new legal cases, aims to restore confidence in the risk analysis system by reshaping the meaning of data ownership in this domain. While this regulatory approach is being established, breakthrough analytics techniques are encouraging thinking about the next steps in managing food safety data in the age of machine learning. The book focuses on two core topics – data ownership and data governance – by evaluating how the regulatory framework addresses the challenges raised by Big Data and its analysis in an applied, significant, and overlooked domain. To do so, it adopts an interdisciplinary approach that considers both the technological advances and the policy tools adopted in the European Union, while also assuming an ethical perspective when exploring potential solutions. The conclusion puts forward a proposal: an ethical blueprint for identifying the principles – Security, Accountability, Fairness, Explainability, Transparency and Privacy – to be observed when processing Big Data for food safety purposes, including by means of machine learning. The chapters focus on the period stretching from the most agitated stages of the ‘scramble for Africa’ during the 1870s and 1880s, to the great wave of independence of African colonies in the 1950s and 60s, and culminates in a discussion of colonial legacies during its aftermath. The Church and the State, although often having conflicting goals and agendas, walked hand-in-hand throughout the entire colonial period, with ‘imperialism of the spirit’ being inconceivable without the groundwork of Catholic missionaries. Exploring the major domains that determined the course of church-state relations in the colonies, the authors analyse relations between the Holy See and the colonial powers, and between national Catholic authorities and secular authorities, as well as the international order and socio-political developments in the metropoles. They argue that interactions between state and church in Africa’s European colonies were contingent upon the complex dynamics of interests that both secular and ecclesiastical entities endeavoured to preserve or promote. This book explains how this new party came into being. Using Rome as its focus, it explains that the rebirth of the PCI required that it subdue other, dissident strands of communist thinking. During the nine-month German occupation of Rome in 1943-44, dissident communists would create the capital’s largest single resistance formation, the Communist Movement of Italy (MCd’I), which galvanised a social revolt in the capital''s borgate slums. Exploring this wartime battle to define the rebirth of Italian communism, the author examines the ways in which a militant minority of communists rooted their activity in the everyday lives of the population under occupation. In particular, this study focuses on the role of draft resistance and the revolt against labour conscription in driving recruitment to partisan bands, and how communist militants sought to mould these recruits through an active effort of political education. Studying the political writing of these dissidents, their autodidact Marxism and the social conditions in which it emerged, this book also sheds light on an often-ignored underground culture in the years that preceded the armed resistance that began in September 1943. Revealing an almost unknown history of dissident communism in Italy, outside of more recognisable traditions like Trotskyism or Bordigism, this book provides an innovative perspective on Italian history.
